Terms of Service

1. Who we are and who these terms apply to

These Terms of Service ("Terms") govern your use of the Smart learning platform, operated by Smart Learning Ltd ("Smart", "we", "us", or "our"), registered in England and Wales.

By creating an account or using Smart, you agree to these Terms. If you are under 18, a parent or guardian must review and accept these Terms on your behalf. If you are a teacher or school administrator using Smart for a class or institution, you also accept these Terms on behalf of your organisation.

These Terms apply to users worldwide. Where your local laws provide additional rights, those rights are not affected.

2. The Smart service

Smart provides an AI-assisted learning platform offering courses, interactive lessons, progress tracking, and an AI tutor ("Gio"). The specific features available to you depend on your subscription plan.

We reserve the right to update, modify, or discontinue features of the service with reasonable notice. We will not make changes that materially reduce the value of a paid subscription without offering a pro-rated refund or the option to cancel.

3. Accounts

You must provide accurate information when creating an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You must be at least 10 years old to use Smart. If you are creating an account for a child under 13 (or under 16 in the EU), you confirm that you are their parent or legal guardian and consent to their use of the platform.

You may not create accounts for others without their consent, or use Smart for any purpose that violates applicable law.

4. Subscriptions and billing

Smart offers free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. All prices are displayed inclusive of applicable taxes.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will retain access until then.

Refunds. We offer a 30-day money-back guarantee on Premium and Family plans. If you are not satisfied within the first 30 days, contact us at support@smartyscholar.com for a full refund. After 30 days, refunds are at our discretion.

Price changes. We will give at least 30 days' notice of any price increase for existing subscribers, and will not increase the price during an annual billing period already paid for.

5. Acceptable use

You agree not to:

  • Use Smart for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to any part of the platform or another user's account
  • Reverse engineer, copy, or redistribute any part of the Smart platform or its content
  • Use automated tools to scrape, crawl, or extract data from Smart
  • Attempt to manipulate or abuse the AI tutor in ways that are harmful or inappropriate
  • Share your account credentials with others or sell access to your account

6. Intellectual property

All content on Smart — including course material, lessons, assessments, and AI-generated responses — is owned by or licensed to Smart Learning Ltd. You may not reproduce, distribute, or create derivative works from our content without written permission.

Your learning data (progress, responses, streaks) remains yours. We process it to provide the service and improve it, as described in our Privacy Policy.

7. Disclaimer and limitation of liability

Smart is provided as an educational tool to support learning. It is not a substitute for professional tutoring, academic advice, or qualified educational assessment.

To the fullest extent permitted by law, Smart Learning Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you in any 12-month period shall not exceed the amount you paid to us during that period.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded by law.

8. International users

Smart is operated from the United Kingdom. These Terms are governed by the laws of England and Wales. However, if you are located in the EU, you retain all rights provided to you under EU consumer protection law. If you are located elsewhere, your local consumer protection laws may also apply and are not excluded by these Terms.

For EU users: you have the right to withdraw from a subscription purchase within 14 days unless you have already accessed the premium content, in which case you consent to the service beginning immediately and acknowledge this may affect your right of withdrawal.

9. Termination

We may suspend or terminate your account if you breach these Terms, with notice where reasonably possible. You may delete your account at any time from your account settings. On termination, your right to use Smart ceases immediately, and we will handle your data as described in our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days in advance. Continued use of Smart after that date constitutes acceptance of the updated Terms.
